1. Service provider identification
These general terms of sale ("T&Cs") govern all photography services provided by Nicolas Jacquet, photographer ("the Photographer"), operating as a cooperative member of SmartBe (Productions Associées) (Rue Coenraets 72, 1060 Brussels — BCE BE 0896.755.397), which handles invoicing, VAT calculation and administrative management.

2. Scope
These T&Cs apply to any service ordered from the Photographer, whether by an Individual client (wedding, portrait, family, couple, maternity, newborn, private event) or a Business client (corporate, business, professional event, real estate, communication).
Some clauses are common. Others are marked (Individuals) or (Businesses).
In case of contradiction between the T&Cs and the signed quote, the quote prevails.
3. Quote and contract formation
Every service is the subject of a personalised quote. The quote is valid for 30 days. The contract is formed upon cumulative receipt of the written acceptance of the quote and payment of the deposit.
4. Prices
- (Individuals) Prices in euros, VAT included (21% Belgian VAT).
- (Businesses) Prices in euros, excluding VAT. Belgian VAT added on the Smart invoice.
5. Payment terms
Deposit (all Clients)
A 30% deposit is required upon acceptance of the quote. The date is reserved upon receipt of this deposit.
Balance — Individuals
The balance is payable no later than the day of the shoot.
Balance — Businesses
The balance is payable within 7 calendar days following the shoot.
Late payment (Businesses)
In accordance with the Belgian law of 2 August 2002 (amended 2021), any delay triggers legal interest + flat-rate compensation of €40.
6. Travel fees
Included in the quote based on the address provided. Any additional travel is invoiced at €2 per kilometre round-trip from Durbuy.
7. Cancellation and rescheduling
Cancellation by the Client — Wedding
Deposit non-refundable, regardless of the cancellation date, due to the specific logistical commitment.
Cancellation by the Client — Other services
- More than 30 days: full refund of the deposit
- Between 30 and 15 days: deposit retained (30%)
- Between 15 and 3 days: 50% of the total amount due
- Less than 3 days: 100% of the total amount due
Cancellation by the Photographer
In case of major impediment, proposal of a replacement or full refund.
8. Outdoor sessions — weather clause
The Photographer is the sole judge of the possibility of carrying out the shoot. A mutually agreed rescheduling does not entail any refund. For weddings, weather never triggers cancellation.
9. Delivery times
- Wedding: 3 months
- Other services: 2 weeks
- Expedited delivery on request, with surcharge
Files retained for 12 months after delivery. RAW files are not delivered.
10. Complaints
Any complaint must be made in writing within 14 days from the gallery being made available.
11. Copyright
Licence — Individuals
Use private, personal and non-commercial. Any resale or commercial use requires written agreement.
Licence — Businesses (standard)
- Beneficiary: the Client (no transfer to third parties)
- Uses: internal and external communication specific to the Client
- Duration: unlimited — Territory: worldwide
- Exclusions: resale, sub-licence, image banks
Use by the Photographer
Unless written objection, the Photographer may use the images to promote their activity.
12. Image rights
The Client guarantees having obtained the consent of all photographed persons.
13. Right of withdrawal (Individuals)
The 14-day right of withdrawal does not apply (art. VI.53 of the Belgian Code of Economic Law), as the service is linked to a specific date and is personalised.
14. Force majeure
No party can be held responsible in case of force majeure. Rescheduling by agreement; failing that, refund of amounts paid.
15. Liability
The Photographer's liability is limited to the amount of the service, except in case of proven fault.
16. Mediation and jurisdiction
(Individuals) Mediation available via the Consumer Mediation Service.
(All Clients) Belgian law. Competent courts: those of Smart's registered office.
17. Acceptance
Acceptance of a quote constitutes full adherence to these T&Cs.
